Terms and Conditions (T&C)

  1. Scope of Application

These general terms and conditions (T&C) apply to all business relationships that customers establish with the seller (Bavarian Fossils, Fabian Weiß) on his online shop.

  1. General

We guarantee you a risk-free purchase of fossils and minerals on the internet. These are exclusively individual pieces, with comparable pieces available in some cases. The acceptance of an order is subject to the availability of the ordered goods.

  1. Conclusion of Contract

3.1 The product and item descriptions contained in the seller's online shop do not constitute binding offers by the seller but serve to submit a binding offer by the customer. The customer can submit the offer via the online order form integrated into the seller's online shop.

3.2 The contract comes into effect ("Conclusion of Contract") when the seller informs the buyer in writing of the acceptance of his offer or by sending the payment request.

  1. Right of Withdrawal

Consumers generally have a right of withdrawal. Further information on the right of withdrawal can be found in the seller's CANCELLATION POLICY.

  1. Prices and Payment Conditions

4.1 All prices stated are final prices plus shipping costs and are VAT exempt according to § 19 (1) UStG. For deliveries to countries outside Germany, additional costs may arise, which are not the responsibility of the seller and are to be borne by the customer.

4.2 The customer has various payment options available, which are indicated in the seller's online shop.

4.4 If advance payment is agreed, the payment is due immediately after the conclusion of the contract.

  1. Delivery and Shipping Conditions

5.1 The delivery of goods is made by the shipping service provider to the delivery address specified by the customer, unless otherwise agreed (e.g., pick-up).

5.2 If the transport company returns the shipped goods to the seller because delivery to the customer was not possible, the customer bears the costs for the unsuccessful shipment. This does not apply if the customer effectively exercises his right of withdrawal.

5.3 In the case of self-collection, the seller informs the customer in writing that the ordered goods are ready for collection. Subsequently, the customer can pick up the goods by arrangement with the seller at an agreed location. In this case, no shipping costs will be charged.

  1. Retention of Title

The seller reserves ownership of the delivered goods until the full purchase price owed has been paid.

  1. Availability Reservation

All offers are subject to change. If it is determined after the conclusion of the contract that the ordered goods are no longer available or for some other reason cannot be delivered (e.g., damage, destruction), the customer will be informed immediately. In this case, the customer can, if available, choose a comparable product in terms of quality and price or withdraw from the contract. Any payments already received will be refunded to the customer immediately upon cancellation of the purchase.

  1. Technical Note

For technical reasons (image capture, monitor, color settings), there may be color variations between the offered items and the original.

  1. Object-Specific Information

All specifications of the offered items as well as additional information are made to the best of our knowledge and belief. Nevertheless, misidentification/misinformation cannot be ruled out. Therefore, there is no guarantee of the accuracy of the item description.

  1. Additional Information

The prices stated are final prices plus shipping and are VAT exempt according to § 19 (1) UStG.

Any input errors when placing your order can be corrected at any time by email, phone, or by placing a new order.

The language available for the conclusion of the contract is exclusively German.

German law applies to the contractual relationship between us and the customer, and the respective terms and conditions. The application of the UN Sales Convention is excluded.

If individual provisions of these T&C are or become invalid in whole or in part, the validity of the contract remains unaffected.
